As for SQL Server licensing costs, more than 90% of the entities out there have purchased the wrong license due to the lack of understanding multiple tier development and incorrect application design. Those companies have purchased CPU licenses at approx $32,000/CPU instead of using the Server plus Device CALs Licensing Model which are around $70/CAL. This is one of the main reasons for developing true 3+ tier applications.

That is basically smoke and mirrors. To this day, this type of licensing has not held up in court. The reason is that it is placing restrictions on the users of the software that you develop, which is not legal. Read it very closely and you will see what I mean. The license is required for the user, not your application. Neither Microsoft or anyone else has the right to charge the users of your software for the use of their server product as the user is not directly using their server product.
